EUCompliance is a compliance management tool. We do not provide legal advice, certification, or audit services. Compliance with EU regulations is the sole responsibility of the organization. Use of this platform does not guarantee regulatory compliance or audit success.

1. Acceptance of Terms

By accessing or using the EUCompliance platform ("the Service"), operated by EUCompliance ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and EUCompliance.

By proceeding with payment, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

2. Nature of the Service

EUCompliance is a software-as-a-service (SaaS) platform that provides compliance management tools, including but not limited to:

  • Control assessment questionnaires mapped to EU regulations
  • Automated evidence collection via third-party API integrations
  • Policy document templates for customization
  • Compliance progress tracking and reporting
  • Gap analysis and remediation recommendations

The Service is a management and organizational tool only. It is not a substitute for professional legal advice, regulatory consultation, or accredited audit services.

3. No Legal Advice or Certification

EUCompliance does not provide legal advice, regulatory certification, or audit services. The information, templates, assessments, and reports generated by the Service are provided for informational and organizational purposes only.

Compliance with EU regulations — including but not limited to NIS2 (Directive (EU) 2022/2555), DORA (Regulation (EU) 2022/2554), and GDPR (Regulation (EU) 2016/679) — is the sole responsibility of the organization using the Service.

Use of this platform does not constitute, imply, or guarantee:

  • Regulatory compliance with any EU or national law
  • Successful completion of any audit or assessment
  • Approval by any supervisory authority or regulator
  • Immunity from regulatory enforcement actions or fines
  • That the control mappings, templates, or recommendations are complete, current, or applicable to your specific situation

Organizations should consult with qualified legal counsel and accredited auditors to ensure full compliance with applicable regulations.

4. "As-Is" Provision

The Service is provided on an "as-is" and "as-available" basis. EUCompliance makes no representations or warranties of any kind, express or implied, regarding the operation of the Service or the accuracy, completeness, reliability, or suitability of any information, templates, assessments, or reports generated by the Service.

To the maximum extent permitted by applicable law, EUCompliance disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • That the Service will be uninterrupted, error-free, or secure
  • That regulatory information is current or complete

5. Limitation of Liability

To the maximum extent permitted by applicable law, EUCompliance shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Regulatory fines, penalties, or enforcement actions
  • Audit failures or non-compliance findings
  • Loss of revenue, profits, or business opportunities
  • Loss of data or data corruption
  • Business interruption or reputational damage
  • Any damages arising from the use or inability to use the Service

The organization acknowledges that compliance with EU regulations is its own responsibility and that EUCompliance is a tool to assist in organizing compliance efforts, not a guarantee of compliance outcomes.

In no event shall EUCompliance's total liability exceed the amount paid by the organization to EUCompliance in the twelve (12) months preceding the claim.

6. Policy Templates and Content

Policy templates provided by the Service are generic templates intended to be customized by the organization. They are not legal documents and should be reviewed by qualified legal counsel before adoption. EUCompliance does not warrant that any template is suitable for any specific organization or jurisdiction.

Control mappings to regulatory articles are based on publicly available regulatory texts and industry best practices at the time of creation. Regulations may change, and EUCompliance does not guarantee that mappings are current or complete.

7. Subscriptions and Billing

The Service is offered on a subscription basis with the following plans: Professional (€799/month) and Enterprise (custom pricing). All fees are exclusive of applicable taxes (including VAT).

Subscriptions are billed monthly or annually, depending on the selected plan. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

By proceeding with payment, you authorize EUCompliance to charge the selected payment method for the subscription fees until cancellation.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated herein by reference. EUCompliance processes personal data in accordance with the GDPR and is hosted on EU-based infrastructure.

9. Third-Party Integrations

The Service may integrate with third-party services (e.g., AWS, Azure, GCP, GitHub, Okta). EUCompliance is not responsible for the availability, accuracy, or security of these third-party services. You are responsible for reviewing and complying with the terms of service of any third-party services you connect to the platform.

10. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service; (c) share your account credentials; (d) use the Service to provide legal or regulatory advice to third parties; or (e) represent that EUCompliance has certified your organization as compliant.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

12. Changes to Terms

EUCompliance may update these Terms from time to time. We will notify users of material changes at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
